ENACTED by the Koru of the Hokorian State under the sovereign authority of the Hokorian State.
Part I- The State and Sovereignty
Section 1- Establishment of the State
- The Hokorian State is hereby constituted as a sovereign state.
- Sovereignty of the Hokorian State is vested in the Koru.
- All authority of the State derives from the Koru and is exercised in their name.
Section 2- The Koru
- The Koru is the Head of State and the supreme authority of the Hokorian State.
- The Koru may exercise authority directly or through delegation.
- The Koru shall ensure the continuity of the State.
Part II- Constitutional Authority
Section 3- Constitutional Orders
- The Koru may issue Constitutional Orders.
- A Constitutional Order may:
- establish, amend or repeal a Constitutional Charter;
- activate, suspend or repeal a Charter or any law made under it;
- declare or terminate a state of emergency;
- provide for interpretation or clarification of constitutional authority.
- A Constitutional Order shall have constitutional force.
Section 4- Constitutional Charters
- A Constitutional Charter shall have effect only where established by Constitutional Order of the Koru.
- A Constitutional Charter shall have such scope, force and duration as specified in the Order establishing it.
- A Constitutional Charter shall have higher authority than any statute or regulation.
- A Constitutional Charter may be amended, suspended or repealed only by Constitutional Order.
Part III- Law and Governance
Section 5- Ordinary Law
- Ordinary law of the Hokorian State shall have effect only where made under authority of a Constitutional Charter.
- Ordinary law shall include:
- statutes made under a Charter;
- regulations made under authority of a statute.
- No law shall have effect unless recognised within this hierarchy.
Section 6- Delegation and Instruments
- Authority may be delegated by the Koru or under a Charter.
- Instruments issued under delegated authority shall have effect only within the limits of that authority.
Part IV- Continuity and Interpretation
Section 7- Continuity of Authority
- The absence, inactivity or vacancy of any office or institution shall not invalidate the authority of the State.
- The authority of the State shall continue at all times through the Koru.
Section 8- Interpretation
- This Constitution shall be interpreted so as to preserve the authority and continuity of the State.
- Where ambiguity arises, the interpretation most consistent with the authority of the Koru shall prevail.
Part V- Amendment
Section 9- Amendment of the Constitution
- This Constitution may be amended or replaced only by Constitutional Order of the Koru.
- No other body may amend this Constitution.
Part VI- Final Provision
Section 10- Supremacy
- This Constitution is the supreme law of the Hokorian State.
- No law, Charter, Order or instrument shall have effect except in accordance with this Constitution.
